FOREWORD
Freedom of Speech and Expression is a Fundamental Right enshrined under Article 19(1)(a) of the Constitution of India. This Right is however not absolute and is subject to certain restrictions, imposed under Article 19(2) of the Constitution of India.
The Grounds on which this Freedom could be restricted are as follows:
- Security of the State
- Friendly Relations with Foreign States
- Public Order
- Decency or Morality
- Contempt of Court
- Defamation
- Incitement to an offence, and
- Sovereignty and Integrity of India
Thus, the preservation of morality and integrity too have been accorded constitutional importance while allowing the Freedom of Speech and Expression.
Even prior to the adoption and enactment of the Indian Constitution by our learned forefathers, great seers of our Country had preached during different times, about the way speech and expression should be conducted by oneself.
For, ‘words’ and ‘deeds’ are the only two means by which one can inflict harm to oneself, others, or the universe at large. Therefore, if these two streams of expression by each one of us could be safeguarded and conducted on the basis of morality and integrity at all times, then, justice, peace, happiness and prosperity would be realized by even the poorest of the poor and the weakest of the weak.
